He?s breathing a bit easier today, and Matthew Fox is relieved that Heather Bormann isn?t moving forward with her assault lawsuit.
According to a report, the Cleveland, Ohio bus driver will no longer seek legal action against the ?Lost? star and has dismissed her lawsuit with prejudice.
In response, Fox immediately retracted his countersuit that previously claimed Bormann had defamed him with her erroneous allegations.
However, Matthew?s former costar Dominic Monaghan is now claiming that Fox has a history of roughing up women, which would make Bormann?s claim that he punched her in the vagina seem credible.

Blake Lively has loved playing Serena van der Woodsen, but she's excited about the prospect of steering her career away from the Upper East Side. The Gossip Girl actress will be shooting the sixth and final season of the hit CW show this summer, and then she'll hang up her stilettos as the primetime soap star.
'I was inspired by how dark it sounded and how heavy and visceral,' Furtado tells MTV News about rap collective.
By Jocelyn Vena
Nelly Furtado proclaims her allegiance to a major fashion accessory — hoop earrings — on her feel-good track "Big Hoops (Bigger the Better)." While she was influenced by her mall-rat youth when she sat down to make the track with producer Rodney Jerkins, it was also the antic-loving rap outfit Odd Future who sonically creeped inside her and totally shaped the record's sound.
" 'Big Hoops' is a special tune for me for a few different reasons," Furtado told MTV News when she stopped by our office Tuesday to discuss the thumping anthem about loving your jewelry and, more importantly, yourself.
"The state of mind I was in, I was actually listening to a lot of different music a few weeks before," she continued. "I think I was listening to Odd Future or something, and I was inspired by how dark it sounded and how heavy and visceral and how it made your blood feel things. And I just thought, 'Wow — that's really missing in music. We're missing that rawness, that energy and that power.' "
When Furtado decided to embrace her own power, she crafted a tune that expresses who she is when she is onstage — full of bravado and holding her "sword," her microphone. "Hoops" also pays homage to the girl she was as a teen growing up in Canada, hoping to become pop star she is today.
"I think music can tap into a lot of powerful emotions, and I think in the studio on 'Big Hoops' I tapped into a really powerful memory of being 14 years old, completely in love with hip-hop and R&B along with all my friends, and putting on my sister's big hoop earrings and heading down to the mall to hang out with my backpack and jeans," Furtado recalled.
She also shared that, in addition to working on her looks back then, she was also "writing rhymes and hanging out and freestyling on the corner and feeling famous already, even though I clearly wasn't at 14."
Despite not yet having fame and fortune, she explained, there was an emotion she felt then that she still feels now: "But I felt [famous], and I think when you're that age, you have your inner gumption already," she said. "So 'Big Hoops' taps into that power."
"Hoops" is the lead single off her upcoming album, The Spirit Indestructible, out in September. It's her first English-language album since the chart-topping Loose, which she released in 2006. She dropped a Spanish-language album, Mi Plan, in 2009.
Making her way around the Big Apple, Scarlett Johansson was spotted hailing a taxi cab in Manhattan yesterday (May 29).
The ?In Good Company? actress looked adorable in a springy floral print dress as she ran out into the street and hopped into the car before speeding off to her destination.
And though she?s been split from her ex-husband Ryan Reynolds since 2010, Scarlett only just listed the home they shared as a married couple.
Johansson and Reynolds are asking a handsome $3.65 million for the two-bedroom, three-bathroom home in Los Angeles. They bought it for $2.9 million.
'The numbers were eye-popping. You'd think Iron Man was in the film,' one box-office expert tells MTV News of new Wes Anderson film.
By Fallon Prinzivalli
As "Men in Black 3" knocked "Marvel's The Avengers" off its record-breaking throne and nabbed the title of #1 film in America over Memorial Day weekend, Focus Features' "Moonrise Kingdom" broke its own box-office records. The Wes Anderson-directed film, which opened in two theaters in New York and two in Los Angeles, grossed more than $669,000 this weekend. It raked in an average of $130,752 per location, setting a new record previously held by 2006's "Dreamgirls."
"Wes Anderson films always open in limited release with very high averages as his fanbase is very loyal," says Box Office Guru editor Gitesh Pandya, "but the 'Moonrise Kingdom' numbers were eye-popping. You'd think Iron Man was in the film."
Jeff Bock of Exhibitor Relations also attributes the success to Anderson's "ardent" fanbase.
"[His fans] have seen him produce just a handful of films over the course of his entire career, which began with 1996's 'Bottle Rocket.' Absence makes the heart grow fonder, and 'Moonrise Kingdom' is Anderson's first live-action film in five years, so there was no doubt a burning desire to see his latest whimsical dramedy," he says. "Filmmakers with unique and authentic voices are far and few between, and Anderson is something of a national treasure for the hipster collective."
"Moonrise Kingdom" takes place in the summer of 1965 and follows the search for two 12-year-olds who flee their hometown in New England for a wilderness adventure. The film's success follows its debut in Cannes, France, where it opened the city's famous film festival. Bock believes its premiere at such a large venue contributed to the buzz, keeping it in the mind of audiences — despite an influx of blockbusters hitting cinemas around the globe.
"There is always room for a small, original tale amongst the blockbuster giants of summer, and 'Moonrise Kingdom' may just be this summer's 'Midnight in Paris,' " he said, referencing the Woody Allen film that won him an Oscar for Best Original Screenplay. "The big test for ['Moonrise'] will be when it debuts in moderate wide release (400-plus theaters), reaching smaller markets that probably haven't seen a film of his since his biggest hit, 2001's 'The Royal Tenenbaums,' which grossed $52 million. While Anderson's films are revered by critics and cinephiles, wide audiences haven't exactly embraced the kooky sensibilities and eccentric outlook he emotes in his films."
But Phil Contrino of BoxOffice.com believes an A-list cast including Bruce Willis, Bill Murray, Edward Norton and Tilda Swinton will help bring the film to a broader audience — though he does think widespread popularity may be limited.
"If you don't like Wes by now, this movie won't change your mind," Contrino said. "He's burrowed very deep into his own style eccentricities."
"Moonrise Kingdom" was too late to earn any Movie Awards nominations at this year's show, but tune in this Sunday at 9 p.m. ET to celebrate your other favorite films, including "Hunger Games," "Bridesmaids" and the final "Harry Potter" film.

'Buy it, steal it, just feel it. I don't care,' frontman Tyson Ritter says of AAR's new album, Kids in the Street.
By James Montgomery
When the All-American Rejects returned in March with Kids in the Street, expectations were high. After all, it was the follow-up to 2008's When the World Comes Down — an album that continued their string of crossover successes thanks to the hit "Gives You Hell" — and powered by slick first single "Beekeeper's Daughter," Kids looked certain to continue that trend.
Of course, to date, Kids has yet to catch fire. It debuted at #18 on the Billboard albums chart and has subsequently dropped out of the Top 200 altogether. But the Rejects aren't worried by that slow start. In fact, to hear them tell it, everything's going according to plan.
"This is the record where we're trying to prove ourselves as an 'album band.' We've done fine with singles," AAR frontman Tyson Ritter told MTV News backstage at the Bamboozle festival. "Our last record, we were so proud of, but 'Gives You Hell,' sort of just steam-rolled the way and let nothing else surface. Honestly, man, we're a whatever-the-hell-anybody-takes-from-us band. Singles, records, buy it, steal it — just feel it. I don't care. Just come to a show."
And it's at those shows where the true scope of the Rejects' accomplishments can be felt. After all, over the course of a decade as a band, they've strung together a series of hits that would give any group pause ("Swing, Swing," "Move Along," "It Ends Tonight," "Dirty Little Secret," etc) and it's gotten to the point these days where the band can actually see the past 10 years play out before their very eyes. Which is why they're not worried about one album; they're career artists, through and through.
"It's been a slow build with this one, but, you know, we're in a climate where guitars aren't as cool as they used to be and, luckily, I feel like our fanbase has sort of hung out and waited for us for four records," Ritter said. "It's [been] 10 years now. We just got done playing shows, on a tour, and there are people that have been there for 10 years, singing 'Swing, Swing' in the back, drinking, and then girls up front with the X's out their hands, singing 'Dirty Little Secret' and 'Gives You Hell.' So it's crazy to look at a Rejects show, and as you scan to the back of the crowd, you're going through 10 years of people."

The adorable pair seemed to be enjoying their time together as the 6-year-old rid of her pink skirt and shirt to reveal a yellow one-piece while the ?Batman Begins? actress kept her jean shorts and tee on in the water.
As previously reported by GossipCenter, the 33-year-old has been hard at work on the set of her newest film ?The Seagull.?
Miss Holmes was spotted out earlier this afternoon drinking a beer and reading a book while in character on its set.
Taking some time for himself, Robert Pattinson was spotted sightseeing in Lisbon, Portugal earlier today (May 29).
Joined by his parents Robert and Clare, the ?Remember Me? stud headed over to the Mosterio dos Jeronimos Cathedral while mobs of fans gathered near to catch a glimpse.
In career news, Robert recently shot down rumors that he was in talks to play Finnick Odair, the handsome tribute in ?Catching Fire.?
"I woke up this morning and saw all these things about me being cast in 'The Hunger Games.? I was kind of curious for a second. So I called my agent. My agent was like, 'No.' [My agent] was like, 'No one's going to offer you that part.' I was like, 'Thanks for the reassurance.' "
After a whirlwind trip to Cannes, France last week and losing sentimental items and trust to TSA on her trip home, Kim Kardashian was looking to let loose.
So she did. The Keeping Up with the Kardashians star made a beeline for Beyonce's concert at Revel's Ovation Hall in Atlantic City, N.J., on Sunday night.
In addition to dancing and singing along to Bey's chart-topping hits, Kim got a chance to chat with the woman of the evening herself backstage. OMG!
The two have plenty to discuss, of course. Beyonce's husband of four years, Jay-Z, is best friends with Kanye West, Kardashian's serious boyfriend.
Says a source klose to Kim:
"Kim thought it was such a great show. There's always some random rumors there is tension between them and there totally isn't! Kim had so much fun."
B's concert weekend, her first since becoming a mom, drew many big names. Michelle, Sasha and Malia Obama were among other notable attendees.
During Saturday's performance (she did four shows there), Beyonce revealed that she's lost 60 pounds since giving birth to baby Blue Ivy Carter.
"Y'all have no idea how hard I worked! They had me on that treadmill. I ate lettuce!" she told her fans. "Now tonight I'm gonna get chocolate wasted!"
That's probably what Kim says about ... chocolate also.
As Gwen Stefani and Gavin Rossdale's little rocker turns 6 on May 26, look back at his cutest (and most stylish!) moments
Stepping out for a promotional appearance, Cheryl Cole was spotted at BBC Radio 2 in London, England today (May 29).
The gorgeous pop singer was kind enough to sign autographs and pose for pictures with fans as she made her exit and headed off to her next appointment.
In a recent interview, Cheryl talked about her beloved canine companions, noting that one of them is definitely gay.
Cole explained, ?I have two chihuahuas, Buster and Coco, and i have two Jack Russells. Buster is definitely gay . He loves the other boys.?
I had my “reporter” cap on as I was reading Michelle Obama’s first-ever book, American Grown, the story surrounding her creation of the White House Kitchen Garden in 2009. I was looking for those little nuggets that might reveal something we never knew about the first lady, the president, the Obama girls, life in the White House, etc. And there are plenty inside this impressive, nearly 300 page achievement, which also includes dozens of beautiful photographs, tips on how you too can start a community garden and recipes from White House chefs for unique and vegetable-filled treats such as cauliflower mac and cheese (Kids, guess what’s for dinner tonight!) and white chocolate-cherry-carrot cookies, which I must try for the next birthday party in our house!

Timothy Busfield's movie date gone awry resulted in a complaint by a woman who said he groped her, and is now going to the L.A. City Attorney.
That office will determine whether to charge the actor, best known for The West Wing, thirtysomething and Revenge of the Nerds, with a crime.
A woman accused Busfield of groping her during a date at a Thousand Oaks movie theater. She went to the police, who have been investigating.
Detectives want to interview Busfield about what happened that night, after which they will send the case file over to the L.A. City Attorney.
Busfield doesn't have to oblige, but either way the case is going to prosecutors.
The good news for Busfield is that the case won't be referred to the L.A. County D.A., who could file felony charges with prison on the line.
The City Attorney can only file misdemeanor charges, and the maximum penalty, which he'd almost certainly not get, is six months in jail.
The beautiful couple looked comfy as they spent their quiet afternoon in the sand as the "Catwoman" actress sported a long, baggy grey sweatshirt.
Of course, when you look like one of Hollywood?s most gorgeous stars you can get away with natural hair, makeup and just a sweatshirt. So how does the Revlon spokeswoman stay ageless?
When recently talking to press, the 45-year-old beauty explained she uses Kinara Spa skincare products and tries to stay as healthy as possible adding, ?It?s cleansing your skin, watching what you eat, no smoking, not too much drinking, no sugar ? just simple,? she admitted. ?And using sunscreen! If you don?t have a good base, then it doesn?t matter what you put on it ? it?s not going to look as great as it could.?
The 38-year-old actress looked enchanting in a bejeweled Prada bodysuit for the front page shot while dishing about everything from marriage and motherhood to Ryan Gosling and body issues.
Highlights from Miss Mendes' interview are as follows. For more, be sure to pay a visit to Marie Claire UK!
On marriage and motherhood:
"Those are such boring topics to me. I am not that girl. I am superstitious. I don't like talking about things that I want in the future because I feel by verbalizing them they won't come true."
On her boyfriend Ryan Gosling:
"He's amazing. He's your dream co-star. I have never felt so creatively satisfied on a film."
On struggling with body issues:
"It doesn't matter what you have or what you look like. It's something everyone has to work at. I realize I have contributed to a certain happy, heathy, empowered image, but that's not all of me. I felt it's important to let women know I have similar struggles."
On her get-gorgeous secrets:
"I run four to five times a week, I don't eat meat - and my skin looks a lot better for it."
On her drive to get what she wants:
"I want it all - heaven and hell. I am very much a go-where-live-takes me kind of person, but I do take care of myself, and what I do have is control over how I live my life.'
According to a story put out by RadarOnline on Sunday (May 27), their sources claim that the former Hollywood couple reunited for a birthday celebration for the man who officiated their 2005 wedding and were even seen ?locked in a 60-second embrace.?
A source who spoke with the Sunday Mirror said that, while Ashton was making a speech at Kabbalah Rabbi Yehuda Berg?s 40th birthday party explaining that Yehuda will "love you unconditionally, no matter what mistakes you?ve made," the actor got emotional as he referred to his own hardships, saying, ?I?ve made all these horrendous mistakes in the last year.?
The "insider" went on to explain that the pair are "still desperately in love and could be on for a reconciliation,? adding that ?the divorce isn?t being processed right now.?
As previously reported by GossipCenter, the "Two and A Half Men" star was caught cheating on the couple's sixth wedding anniversary at the San Diego Hard Rock hotel with a 23-year-old mistress. Since then, the "Ghost" beauty has changed her Twitter name from MrsKutcher to JustDemi, but so far neither party has officially filed separation papers.
Jenny McCarthy and Brian Urlacher, star of the NFL's Chicago Bears, are totally a couple, according to reports. Reports she confirmed this weekend.
The football great joined McCarthy Thursday night at Rockit Bar & Grill for the “Rescue Our Angels” event, benefiting Jenny’s autism charity.
Asked about Urlacher at The Generation Rescue Foundation event by WMAQ-Channel 5, Jenny McCarthy said, “Yes, it’s true, we are dating.”
Despite attempting to hit out-of-the-way meeting places, the couple hadn’t been able to hide their budding romance, try as they might.
“Let’s face it, it was really already out there, everybody knew it,” she said.
Also, the relationship apparently has reached a point where McCarthy feels it’s “the real deal and will last,” added a source close to her.
McCarthy clearly was not hiding anywhere or anything Friday. She joined about 30 close Urlacher friends to toast his 34th birthday.
Jenny, 39, recently announced that she'll be posing in Playboy again nearly two decades after it put her on the map.
